(1) If there is an order to demolish any building, structure or any part thereof according to sub-section (4) or (5) of section 39, if there is an appeal against such order according to section 40, within thirty-five days from the date of the decision of the district court to demolish such building or any part thereof. And if there is no appeal, within thirty-five days from the expiry of the appeal deadline, the concerned person shall demolish such building, structure or any part thereof in accordance with the order of the chairman or chief or the decision of the district court.
(2) If the concerned person does not demolish such building, structure or any part thereof within the time limit as per sub-section (1), the municipality or the municipality shall demolish such building, structure or any part thereof and the expenses incurred in such demolition shall be recovered from the concerned person.
